This Privacy Policy describes how DUALSTACK LLC (“DUALSTACK,” “we,” “us”), a Florida limited liability company, collects and uses information in connection with our website (dualstack.llc) and our managed software services, including those provided under our operating brand Mako.
1. Who We Are
We are a business-to-business services company. We act in two roles: as a controller of information about our own clients, prospects, and website visitors; and as a processor/service provider of personal data belonging to our clients’ customers (for example, call recordings and WhatsApp conversations handled by systems we operate on a client’s behalf).
2. Information We Collect
From website visitors: contact information you send us by email; basic technical data (IP address, browser type) collected through standard server logs and, if enabled, privacy-respecting analytics.
From clients and prospects: business contact details, billing information, and the account access you grant us to deliver services.
On behalf of clients (as processor): communications data processed by the systems we operate — such as voice-call audio and transcripts, WhatsApp message content, scheduling data, and advertising performance data. This data belongs to our clients and is processed under their instructions.
3. Payment Information
Payments are processed by Stripe, Inc. We do not store full card numbers on our systems. Stripe’s handling of your payment data is described in Stripe’s privacy policy.
4. How We Use Information
To provide, operate, and improve the contracted services; to communicate with you; to bill and collect payment; to comply with legal obligations; and to protect our rights. We use client-customer data (processor role) only to deliver the contracted services — we do not use it to train general-purpose models, and we do not sell it.
5. Sharing
We share information only with: service providers necessary to operate (Stripe for payments; cloud infrastructure; AI model providers; telephony and messaging providers including Meta’s WhatsApp Business API); professional advisers (legal, accounting) under confidentiality; and authorities when legally required. We do not sell personal information.
6. International Transfers
DUALSTACK LLC is a United States company based in Florida. Our engineering and operations team works from the United States and Colombia, and our clients are located in the United States and Latin America. Information may accordingly be processed in the United States, in Colombia, and by service providers in other jurisdictions, subject to appropriate safeguards.
7. Retention
We retain client account information for the duration of the engagement and as required for legal and tax purposes. Data processed on behalf of clients is retained per the client’s instructions and deleted or returned upon termination of services, subject to the handover window in our Terms of Service.
8. Security
We use reasonable administrative and technical safeguards appropriate to the nature of the data, including access controls and encrypted transmission. No system is perfectly secure; we will notify affected parties of breaches as required by law.
9. Your Choices and Rights
You may request access, correction, or deletion of your personal information by emailing hello@dualstack.llc. If your data is processed by us on behalf of one of our clients, we may redirect your request to that client, who controls the data. We honor applicable rights under United States federal and state privacy laws and, for data processed in Colombia, under Colombian data-protection law (Ley 1581 de 2012).
10. Children
Our website and services are not directed to individuals under 18, and we do not knowingly collect their data.
11. Changes
We may update this policy; the effective date above will change and material updates will be communicated to active clients by email.
